Nick Jr Fan Club Terms and Conditions

New Members – November 2020

We have a few rules (these “Terms“) which you’ll need to know and follow when you join the Nick Jr Fan Club (the ” Club“) operated by us, Nickelodeon UK Limited (Company Registration No: 2797365) of 17-29 Hawley Crescent, London, NW1 8TT (” Nickelodeon“).

These Terms include details about how to register for the Club, membership benefits and anything else Nickelodeon thinks you may need to know about being a member of the Club. These Terms will apply to Club registration and membership, and by registering for the Club and becoming a member of the Club you promise to follow and be bound by these Terms (which may be amended or varied at any time by Nickelodeon with or without notice) and by Nickelodeon’s decisions, which are final in all matters relating to these Terms and the Club, and no correspondence or discussion shall be entered into. Any enquiries about the Club should be sent to letterbox@nick.co.uk.

WHO CAN BECOME A MEMBER?

1. To be eligible to become a member of the Club, you must:

a) be aged 18 years or over;

b) live in the UK or Republic of Ireland; and

c) have a valid email address.

HOW TO BECOME A MEMBER

2. To become a member of the Club, you must do the following:

a) go to www.nickjrfanclub.uk (the “Club Website“) and complete the online registration form, including first name and valid email address; and

b) confirm that you are aged 18 years old or over; and

c) agree with these Terms and the Privacy Policy (defined below) by checking the relevant unchecked boxes

(together a), b) and c) above shall be a “Registration“).

If you want to receive a birthday email for your child you will also have to provide their month of birth although this information is not mandatory.

3. No purchase is necessary in order to join the Club, but you will need access to the internet in order to access the Club Website and enjoy the Membership Benefits (see clause 7 for these benefits). If you aren’t the person paying the bill then please check with them before registering.

4. Registration can only be completed via the Club Website, and registrations submitted by any other method will not be valid.

5. Please take care when completing the Club registration form to ensure that we have your correct details. Any Registrations which are incomplete will not be valid. Nickelodeon is not responsible if your Registration gets lost, delayed, misdirected, is undelivered or if you have technical problems trying to join the Club.

HOW TO CANCEL YOUR MEMBERSHIP

6. Members may cancel their membership by selecting the “unsubscribe” link in any of the Club’s monthly newsletters. Upon clicking and following such link, members of the Club will then be asked to re-enter their email address in order to confirm that they wish to unsubscribe from the Club.

MEMBERSHIP BENEFITS

7. The current benefits of membership of the Club are the following:

a) a “sign up” confirmation email at point of registration;

b) a welcome email with printable activity pack after confirmation of registration;

c) monthly Club newsletter emails; and

d) a birthday email for your child (if you provide your child’s month of birth) (commencing 1 June 2018)

(together, a), b), c) and d) are the “Membership Benefits “).

8. Nickelodeon has the right to cancel any member’s Club membership if that member does not comply with these Terms, agree with the Privacy Policy or Nickelodeon has reasonable grounds for believing that a member has broken a rule contained in these Terms.

PRIZE DRAW – AMAZON VOUCHER

9. During the month of November 2020, any new members that register to join the Nick Jr. Fan Club in accordance with these terms and conditions, will have the opportunity to opt in for a chance to win a £100 Amazon voucher. Nickelodeon will be the promoter of the prize draw. Important Dates for the prize draw:

Opening Date:	00:01am on Sunday 1 November 2020 (” Opening Date“)
Closing Date:	23:59pm on Monday 30 November 2020 (” Closing Date“)

9.1 To be eligible to enter the prize draw:

(a) You must be a new member of the Nick Jr. Fan Club;

(b) You must check the unchecked box to opt in to the prize draw on the Nick Jr. landing page;

(c) You must be aged 18 years old or over; and

(d) You must live in UK and ROI.

9.2 To enter the prize draw go to https://www.nickjrfanclub.uk/ and fill in and submit the sign up form which will be available between the Opening Date and Closing Date. This involves:

(a) providing your personal details (first name and email address);

(b) confirming that you are aged 18 years or over, live in the UK or Republic of Ireland and have read and accepted the standard fan club terms and conditions and our privacy policy;

(c) confirm that you would like to “opt in to the Amazon voucher prize draw” and confirm you’ve read and accepted these Terms; and

(d) selecting the box to “subscribe to the Fan Club”

(together, an “Entry“).

9.3 For the avoidance of doubt,

(a) existing fan club members are not eligible to enter the prize draw; and

(b) any new members that sign up between the Opening Date and Closing Date, who do not opt in to the prize draw at the time of subscribing to the fan club, shall not have the chance to enter the prize draw afterwards.

(c) Entries received after the Closing Date will not be valid, and will be automatically disqualified. Nickelodeon is not responsible if your Entry gets lost, delayed, misdirected, undelivered, damaged regardless of cause (e.g. technical malfunction, or if you experience any computer hardware or software or technical problems of any kind) when trying to enter the prize draw.

9.4 Only one (1) entry is permitted per entrant. Multiple entries will be void and the entrant disqualified.

9.5 There will be four winners (“Winner(s)”) of the prize draw.

9.6 Each Winner shall receive a £100 Amazon voucher (“Prize”). There is no cash alternative to the Prize.

9.7 The Winners of the prize draw will be the first four Entries selected randomly by Nickelodeon from all valid Entries received between the Opening Date and Closing Date.

9.8 The Winners will be selected on or around Friday 4^th December 2020 and Nickelodeon will notify the Winner on or before Friday 11 December 2020 by email that they have been successful.

9.9 Prizes can only be sent to a UK and/or Eire address so if a Winner has moved somewhere outside the UK/Eire after entering the Competition, their Entry will not be valid.

9.10Nickelodeon reserves the right to choose an alternate Winner if:

(a) a Winner does not comply with these Terms or Nickelodeon has reasonable grounds for believing that a Winner has broken a rule contained in these Terms; or

(b) a Winner does not (i) agree to these Terms; (ii) want to receive the Prize; or (iii) give any consent as may be requested by Nickelodeon within forty-eight (48) hours; or

(c) Nickelodeon cannot contact a Winner or a Winner does not respond to any requests from Nickelodeon for information (e.g. confirmation of their address) within forty-eight (48) hours of such request.

9.11 Please take care when entering the prize draw to ensure that you provide your correct contact details. Any Entries which are incomplete and/or cannot be read clearly will not be valid and will not be entered into the Competition.

9.12 Nickelodeon shall at its sole discretion determine whether an Entry is valid, based on the entry requirements set out in these Terms. Each valid entry will be entered into the Competition. Entries that do not comply in full with these terms and conditions will be disqualified.

DATA PROTECTION AND PRIVACY

10. Any personal information collected by Nickelodeon in connection with the Club will be used in accordance with Nickelodeon’s Privacy Policy set out at http://www.nickjr.co.uk/privacy-policy/ (the “Privacy Policy“). A copy is also available by sending Nickelodeon an email to dataprivacyrights@viacom.com or a letter to our address above marked for the attention of The Data Protection Officer.

11. Personal information collected from members of the Club will be used by Nickelodeon solely in connection with the Club and we will not disclose your personal information to any third party except for the purposes of operating the Club and/or providing the Membership Benefits. For example if you win a competition, we may need to pass your information to a third party to arrange delivery of your prize, or we may need advice from an auditor or legal adviser. We currently use The Promotions Factory Limited (company number 03687321) to assist us with competitions and the provision of the Membership Benefits. We will make sure that any third parties keep your information secure; only keep the information for so long as is necessary; and will comply with all applicable laws and regulations.

12. The member of the Club’s name, e-mail address and child’s birth month (if provided) will be retained in order to send the monthly Club newsletter and fulfil other Membership Benefits. If a member chooses to unsubscribe in accordance with clause 6 above, all of their personal data shall be permanently destroyed.

GENERAL

13. All changes to the Terms will be posted in revised terms and conditions on http://www.nickjrfanclub.uk/

14. Events may occur that render the provision of the Membership Benefits (or any part thereof) impossible due to reasons beyond the reasonable control of Nickelodeon. Nickelodeon will not be liable or responsible for any loss or damage suffered by the member should they not receive or be able to receive the Membership Benefits (or any part thereof) as a result of any such event. In particular, Nickelodeon shall have no obligation to substitute any alternative prize, cash equivalent or provide any other compensation.

15. Nickelodeon reserves the right to cease operation of the Club at any stage and for any reason.

16. Nickelodeon will not be liable to you for any delays or failure (whether in whole or in part) in carrying out its obligations in respect of the Club due to circumstances beyond Nickelodeon’s reasonable control. You will be solely responsible for any costs incurred by you as a result of such delays and/or failures.

17. Nickelodeon will not be liable to you for any loss or damage however it was caused (including without limitation in contract, tort or statutory duty) in connection with the Club, other than for death or personal injury caused by Nickelodeon’s (and/or its employees’) negligence.

18. The Terms in respect of the Club are governed by and construed in accordance with the laws of England and Wales and if there are any disputes the courts of England shall have exclusive jurisdiction.
